• I bought a car from a seller but his signature at RTO was a fake

I bought a car from a seller but his signature at RTO was a fake one, most likely the dealer of the car gave a fake signature and submitted at RTO. Now car name transfer process is stuck (the document is stuck at RTO and transfer is not happening). I had given this work to a agent and he keeps delaying it saying its stuck. What are my options. The previous seller is going to leave the country by end of July or August starting. tHis has been dragging for past three months.

Hello,

1) Tell the agent he needs to do whatever it takes to get the work done in a week's time. If he fails to do file a police complaint against him.

2) Send legal notice to the agent and the seller asking then to take appropriate steps to rectify the mistake and get the registration dinner in your name in the stipulated time.

3) The fact is that a new application can be moved with the right signature of the owner(seller). If your agent is not doing it get someone else to do it and take the offending agent to the police.

1) file case of cheating, criminal breach of trust , against seller under section 406, 420 of IPC

2) return the bike to seller . seek refund of money paid by you to the seller . if he fails to pay file suit to recover money paid by you

Dear Concerned,

In such a case it is better to contact the seller directly and request him to re-sign the forms , if he can accompany you to the RTO office it would be extremely helpful for you, you may meet the RTO and give an application , most possibly your work will be done then and there.

If the dealer is cheated by selling the car with fabricated documents, then you may lodge a police complaint against him for the offences of cheating.

The car owner also may be implicated in the complaint for the cheating offence, so that he will run to solve this problem under pressure.
