• Is Indian consulate attestation needed for notarised document?

Sir,

Am disposing my property in India and As I am out of country, my mother holds my GPA there.
Bought the property with housing loan from SBI. The buyers now paid the amount to the SBI but they are asking for a notarised authorisation letter from me to release house title deeds. I am residing in canada now.
Is it enough to just notarise the document or does it need indian consulate attestation as well?

1) it is advisable to get the authorisation letter signed by you for release of original title deeds attested before Indian consulate

2) since your mother is holding power of attorney she can give authorisation letter to release the title deeds

1. Yes, do make a POA executed from CANADA and Notarise it..

2.Then get it attested it by the local Indian Consulate officer.

3.Then you require to send the same to India by post which on receipt is further required to be adjudicated fromIndian collectorate after which only it na be effected upon in india.

So do accordingly.

The authorization deed executed from a foreign country if notarised by a notary of that country would be sufficient and further attestation by Indian consulate is not necessary.

If you are not able to find a notary to get your document attested, you can approach the Indian Consulate/High commissioner office of that country, prove your identity, Get the copy attested by an authorised officer of the consulate.

Attestation either by a Notary Public or by a designated officer of the Indian Embassy of that country shall be sufficient.

1. When your mother holds a GPA executed by you she is free to sell the property for and on your behalf. The GPA has to be registered in India or attested by Indian Consulate if it was executed outside India.

2. The buyers are only being prudent to seek authorization letter from you. There is no harm in sending one. It should be attested by the Indian Consulate.
