My father has two wives. First wife expired long back. After that my father married second woman. I am the daughter of first wife. I have two sisters and one brother. My step mother has got seven children. So we are total seven sisters and four brothers. My father expired without writing will. I want to know whether I will get equal share from my father's self acquired property along with my brothers or I will get more since I am the daughter of first wife who has only four children.

Dear Concerned,

Yes you have an equal right in the property self acquired by your father however the entire self aquired property has to be equally divided among all siblings.

Hi

You are entitled to a share of all of your father's self acquired properties.

The shares of your father will be divided in to 12 parts( step mother, 7 sisters and 4 brothers).

You can still ask for partition by branch(first wife children 1 part)&(Second wife children 1 part) if the self acquired property is a residential house.

You have all the rights to succeed to all the properties of your father along with your brothers.

My father expired without writing will. I want to know whether I will get equal share from my father's self acquired property along with my brothers or I will get more since I am the daughter of first wife who has only four children.

Now you are total 12 legal heirs to your deceased father to share his properties as successors in interest.

His properties shall be divided into 12 equal shares and you are entitled to one such share.
