My brother wants to marry with a girl and we are not ready for Marrige due to bad girl family and girls abuse to mother and sister.my mother is widow and age 60 yrs.the girl family nd brother, Marrige done in a temple few days back.he is not come in home from that day.brother is working in an inter college as LTGrade teacher he found his job after father's death as anukampa niyukiti now he is not ready to take the responsibility of family which was depend on father.i have two sister and one brother.In this situation what can I do to stop this marrige legally. 1) Unfortunately, you can't do anything legally to stop the marriage as law permits to adults not within prohibited degree of relationship to marry. And besides they are already married in a temple.
2) What can be done is, your mother can file a case in the Magistrate court seeking maintenance from your brother especially as he got the job on compassionate grounds after your father's death.
3) If the sisters are unmarried they too can file for maintenance against your brother.
1. if your brother does not come or take responsibility of family then you could nothing.
2. Only your mother can file case of maintenance agaisnt her son so he is directed to provide maintenance to your mother.
3. Your sisters have no legal rights against their brother.
4. Since he has already married you can not stop him from marrying .
Your brother is an adult and free to marry girl he wants
2) if brother is refusing to maintain mother and siblings dependent on him the your mother can file case under section 125crpc and seek maintenance for him
1. You can not stop the marriage of your brother under any circumstances.
2. our brother is an adult citizen of India and has the liberty to legally solemnise marriage with any woman he finds it suitable without your consent.
3. However, your mother can file a case against him u/s125 of Cr.P.C. claiming maintenance for him which he will be bound to pay as per Court order.
You cannot stop the marriage which has already been solemnised as per your own statement.
Further your brother is an adult hence nobody can stop he getting married to a person of his choice provided she is also of marriageable age.
If he is not taking care of his mother, then she can claim maintenance from him by filing a petition before court under section 125 cr.p.c.
1. You are nobody to stop his marriage. If he has attained the age of marriage then he is free to get married to anybody he desires. The maximum you may do is snap your social ties with your brother if you are offended by his choice of life partner.
