• Veterinarian Job - Age related Query

I am a Vet, Passed my Bachelor degree in 2016. At that time HPSC re-advertised veterinarian jobs in 2016 but they kept the age requirement as that of previous advertisement i.e. 1 June 2015. But as per the rule of HPSC that age should be considered for the year in which the jobs are advertised, my batch mates filed a case and won. And now they had to readvertise the Jobs in 2017 according to court's notice with the age requirement of 1 june 2016. Now can i file a case again to increase the age requirement to that of 2017 because the jobs are being readvertised in 2017 ???

If according to you and the directives given by the Court, HPSC at the time to re-advertising ought have made 2017 as the benchmark for calculating/reckoning the age limit, you can approach the Court by way of filing a contempt petition against HPSC. In the alternative, you can also file a writ.

You may file a case taking a precedence of the the previous case won by your friends.

But you should make sure whether both the circumstances are similar and whether this will be maintainable to your situation.

Actually for a job recruitment, the rules shall be framed as per the current situation only and not as per the previous situation, the age criteria falls under that situation only.

1. you can file a writ on the same basis and produce previous judgment as basis for judgment.

2. it is settled law that only back log vacancy can be advertised with retrospective effect. in your case this is not back log vacancy so age should be computed from the date of advertisement.
