• Regarding lost sale deed

My mother buyer a property in 1993 through sale deed in the year 1993 but she somehow could not reconciliation the sale deed from the registry office due to her lack of knowledge and my father's bad interference in those days also my father did not answer whether he took the deed from the registry office or not.my father and mother are now separated. Can she get the sale deed now if so from where and how

Since you're from Kolkata if you bring the certified copy of the deed I may render necessary help.

Certified copy of the original is valid document when the original document is lost or destroyed.

If the description of the proeprty appearing on the deed matches with the proeprty in reality then you need not bother ahs been mentioned in the registry office record.

1)your mother must be having the original receipt issued at time of regsitration of sale deed

2) with the help of said receipt she can obtain original sal deed regsitered with the sub registrar office

She has to conduct a title search in the office of sub-registrar to obtain a certified copy of the sale deed. Engage a local lawyer for this as without a lawyer such documents are difficult to pull out from SRO.

1. If the sale deed was not handed over to the buyer immediately at the time of registration (which was a practice earlier), the registry office certainly had issue a receipt called IGR to her which she shall have to produce now before the Registrar to collect the sale deed.

2. She should now visit the Registry office now to check weather the said sale deed is still lying with the registry Office or not.

3. If the original sale deed is not found at the Registry office, she can collect certified copy of the same from the said office.

1. If the details of the land mentioned in the certified copy of the deed does not match with the details of the property in possession of your mother then she has either taken possession of the wrong property or the details mentioned in te deed is wrong.

2. She shall have to find out exactly which property she has purchased and take steps to correct her record accordingly.
