• Lost Adoption Deed

Dear Lawyers,

I was adopted from Coimbatore and have been living in Chennai for the past 23 years. My parents have lost the adoption deed, and the name provided in my birth certificate is "Sudan" however my name in all my documents state "Sudhan". Now i am unable to apply for a passport. Please advise me on how to proceed.

a. I would like to get my Adoption Deed for any future needs
b. I need to get my Birth Certificate
c. I need to get a Passport

1) if the adoption deed is regsitered you can obtain certified copy of adoption deed from sub regsitrar office

2) to rectify the typographical error in birth certifcate apply to registrar of birth and deaths

3) if he refuses to rectify and insist on court order you will have to file writ petition in HC to direct registrar to rectify the mistake

4) then you can apply for passport in your name

An adoption deed requires mandatory registration for the adoption to be valid. So you may obtain a certified copy of the adoption deed from the office of sub-registrar where it was registered.

1. publish a notice in a daily news paper. thereafter apply for correction of name in birth certificate.

2. matriculation certificate is widely recognized document for name and DOB. you should produce 10th certificate in support of correct name.

3. adoption deed is not required to produce because :

a. such deed is not mandatory in law.

b. if name of adopted father is bearing in all the requisite document then it is not necessary.

Birth certificate would be registered with muncipal corporation only

2) it would not be a problem

3) you can visit municipal corporation office and take search in its records for copy of your birth certificate

This could also be a huge impediment. Better arm yourself with all the documents before you apply. So apply for the certified copies of all documents that you do not have originals of.

If your adoption deed was a registered document, you can get a certified copy of the same from the concerned registrar's office, you have to apply for it.

If the adoption deed was not registered then the adoption itself would be invalid and you cannot get a copy of the same once you report it to be lost.

After getting a certified copy of the deed from the registrar's office you may proceed with other related tasks connected to this.

Thanks a lot Also my birth certificate is not available in the government website, it was registered in a municipality. Would this be problem, as I hear passports will be verified with the government website.

and what documents would i need in order to get it on the website from municipality?

For obtaining birth certificate you can apply for the same from the concerned birth and deaths registration authorities or municipality.

Since you did not find the details in internet, you can approach the authorities directly for relief
