• Can you kindly advise me?

I have a house maid. For three months she cried telling that her land lady was demanding to have a lease for one lakh and that for that she would provide rent free living until it was repaid. Otherwise she would be evicted from her apt. I told her that I would not lend her one lakh of rupees. Then she said I could lend the money to her land lady for the premises and she would pay the rent every month out of her salary. The money was supposed to be returned in eleven months. Now it has been 16 months, the money still has not been repayed, the maid is now telling that we took her rent from her against her will. Yes we absolutely understand that we should not have gotten involve. Yesterday we told the maid not to come back to our premises. Please advise.

1)how did you make payment by cash or cheque?

2) do you have any receipt from landlady ?

3) any written agreement with maid ?

4) in absence of any documentary evidence you would not be able to recover money from the maid

5) even if you file a case it would be diffcult to get relief as you would not be able to prove money was given to landlady on behalf of the maid

You have to claim your money of Rs. 1 lakh from owner of premises along with interest. Your house maid can tack advantage if you insist on her so better to ask to the apartment owner to whom you have given money and the owner is bound to refund the amount with interest.

It seems that you executed no agreement or promissory note with her or her landlady before lending the amount. So the only advise that one can give you is that get rid of her from your house at the earliest as these people can embroil you in false criminal cases.

How did you transfer the money of her landlady?

Do you have proof to prove that this money was transferred for the purpose of lease?

Whether anything in writing was obtained from the servant maid about this arrangement

Did the servant maid pay you anything or any money adjusted out of her salary towards the rent so far?

Without any proof for lending the money you canot legally recover the same from her.

To retain or terminate her services hall be your sole discretion, she cannot force you
