• Drivers license with different DOB

Hi, I have my Indian drivers license with different DOB while my every other document has a different DOB. Now that, I have applied for Indian Drivers License Verification(IDLV) at Indian consulate, Sydney and they have asked me to submit an affidavit mentioning why my Date of Birth in license is different from the one in my Passport! What can be the possible reason to convince embassy now? I'm worried about after effects if it goes wrong!

1)do you have your birth certifcate?

2) your school leaving certifcate ?

3) date of birth mentioned in passport , driving licence should be the same

4) if date of birth is wrongly mentioned in driving licence mention so in your reply

You should get the DOB on your drivers license rectified by making an application to the RTO in this regard, failing which you will be at the mercy of the Indian Consulate. The only plausible reason which you can give is 'typographical error', but as I said this will leave you at their mercy. Better apply for rectification to RTO, and if he does not rectify it then you would require an order from civil judge.

1. The correction of DOB is Driver;s license is not so easy and hence that is not a wise idea.

2.Rather you have to make an affidavit stating your actual date of birth and mentioning the documents where such DOB is mentioned.

3.You have to affirm that affdaivt in local Indian Consulta eoffice.

4.That is enough to resolve the dispute. You can also make a public notice of this affidavit as well by way of newspaper advertisement.

1) you can enclose documentary evidence like your birth certicate , school leaving certifcate to show that in driving licence date of birth was mentionly wrongly

2) mention that in adertently wrong date of birth was mentioned by RTo agent .

3) please note that indian consulate would not validate your indian driving licence unless the mistake in your indian licence is rectified

A. affidavit cannot be given for other's act/work. affidavit always given in support of the person who makes himself bound by the statement given in affidavit.

you should state in affidavit all the facts regarding the documents bearing your correct DOB and aver that

1. all the requisite documents were given to the concerned authority at the time of issuing of licence.

2. error may be caused by the issuing authority.

3. it is a clerical error and needs to be correct.

4. there was no prejudice at the time of application of said licence.

you cannot give affidavit in respect of error made by the RTO. it is responsibility of the RTO to issue DL with correct information. your only liability is to furnish requisite documents. therefore affidavit should be given in support of the fact that all the requisite documents were given and there was no prejudice to get DL with wrong DOB.

First of all ascertain that how this error happened?

If it was done intentionally for some wrongful gins then you may hve to undergo the consequences

If it was by over sight or by an error, then you may give an explanation to that effect in the form of an affidavit and get it notarised.

Send the notarised affidavit containing explanation to the authorities and give an assurance to effect the correct date of birth in the driving licence and you can take steps to correct the same with the licensing authorities in India as per rule in this regard.

Now that I'm overseas, I can't get that done from RTO and I don't need corrections on my drivers license as I'm applying for Australian license. All I need is an appropriate reason to support wrong DOB on document so I can mention that in affidavit requested by Indian embassy now. (Actual reason being agent's mistake and he never did get me that corrected after that, now that RTO is not okay to correct it )

Since you have got the licence procured somehow through an agent considering your urgency or for any other reason, you may give an affidavit stating the error occurred by oversight and was not intentional or wanton.

The explanation should be convincing so that the authorities condone the lapse and admit your reasons for this error to issue a new DL of that country.

1. Get an affidavit executed before a 1st Class judicial Magistrate at your place in India affirming that due to oversight a wrong date has been mentioned in your driving license which was also over looked by you and the RTO is required to be directed to change your DOB according to all your your other records.

2. With this affidavit affirmed before the RTO, you can get a fresh driver's certificate with corrected DOB.

3. Alternatively you can get the driver's license renewed by your Indian consulate with corrected DOB based on the said affidavit affirmed before the 1st Class Judicial Magistrate.

1. In the stated instance, you should write that it has been done inadvertently which was also overlooked by by you.

2. Indian consulate may not agree for renewing the said license with wrong date of birth and may insist for without correcting it.
