• Will I be in trouble if he commits suicide

Sir / Madam.
My friend Sanjay borrowed 2 lakhs from me on Sept 2015 and a document was made out and was stated that he promised to return the money in 6 months. Eg Feb 2016. But the money was not returned, On 18 June 2016 he issued a cheque that bounced.and I was running everyday and week asking him for the money. But for 1 year he had not returned my money, so I eventually got another cheque from him on Oct 2016 but was asked by him not to deposit it as he has no money in the account, afraid that the cheque will bounce again I didn't deposit it. Finding that he is not willing to pay me back, I was adviced to do something else, so I told him that I need 4 Computers on credit, to sell and retrieve my money which he gave me computers worth 2,50,000, but the person who promised me a project rejected it. so I kept the system with me as a security deposit and told him that it will be with me till he pays back my money. He calls me and messages me too stating that he abetting a suicide note. What can I do Sir.

File a complaint against him before police or court for his illegal threats.

If he commit suicide and left a note then a criminal case will be registered against you under section 306 of IPC.

1) you should sell the computers and recover the money from sale of computers as agreed upon between you and your friend

2) meet him and reach an amicable settlment

3) if your friend commits suicide and leaves a suicide note blaming you then you would be in ttroublke for abetting suicide

If he commits suicide then you may be prosecuted for the offence of abetment to suicide. So send a written complaint to the jurisdictional police station through a registered AD to inform them about the threat of your friend, which can act as a shield for you if he commits suicide.

You secure those evidences where he has threatened to commit suicide.

Lodge a complaint with the police about the loan he has borrowed from you and not returning it despite many requests and demands made.

You can complaint that he is intending to cheat you by not returning the money hence action to be taken against him as per law since he has also issued notice threatening to commit suicide if you demand the same again.

This complaint will protect you against any such action he may try to do in future.

1. Lodge a police complaint immediately for his blackmailing you by threatening you to commit suicide for your seeking recovery of the loan amount provided to him.

2. Your idea of security by keeping the Computers may not be considered a good idea since after some time the configurations of those computers will become old and value less and you will not be able to fetch the required amount but he also will loose the amount he has paid to buy theose computers.

3. Return him those computers and deposit the said cheque and also initiate cheque dishonour proceedings u/s138 of N.I. Act against him in case the said cheque is returned by his Banker without honouring it.
