• How to change parents name if a major is adopted

I am atul kumar, age-30 yrs, i was adopted by my uncle 17 years before. however the adoption is registered after 17 years on 11 nov 16. my parents name was not changed in all my school, university certificates and all my id cards. now i want to change my parents name in all documents. pls tell me the procedure to change my parents name. my adoptive father also passed away. my adoptive mother signed the adoption.

What is the evidence of adoption 17 years back ?

2) was adoption deed executed 17 years back ?

3) if adoption deed is executed and registered now name of adopted parents cannot be reflected in your educational certificates

1. The adoption deed is not valid since you became major by that time.

2.However if this is a deed of declaration of past adoption then it is alright.

3. No name appearing on the public document can be changed now.

1. If the adoption deed has been executed now then your academic certificates which reflect the name of your biological parents as on the date of issue of the certificate. However, you can change your parents name in the documents of identity by applying to the competent authority. For change of name on adhaar you have to apply to UIDAI whereas for change on the PAN Card you got to apply to the Commissioner of IT.

2. If your request is turned down then you will have to seek appropriate directions from the competent court.

Adoption of major or adult is not valid and cannot be done.

The registration of the adoption deed may not be mandatory as per section 17 of registration act, however;

Section 49 states that:

49. Effect of non-registration of documents required to be registered

No document required by section 17 32[or by any provision of the Transfer of Property Act, 1882] to be registered shall-

(a) affect any immovable property comprised therein, or

(b) confer any power to adopt, or

c) be received as evidence of any transaction affecting such property or conferring such power, unless it has been registered:

Change of adoptive parents to that of the original parents in the birth certificate or educational certificates may not be possible, you may change the same in Aadhar or any other document which has been created now.
