• Advice on marriage dispute case

Sir mera nam ashish hai shaddi kai kuch hi month bad meri patni kinhi karno se zhagda karke ghar chod gyi thi hamne shaddi mai jo mediator thai unse unko samzhano ko kaha but wo log usko nhi bhej rahe hai.
Uskai bad humne lawyer se advice lena shuru kiya to kuch log koi section 9 case hota hai wo lagane ko bolte hai aur kuch lawyer se simple notice bhejne ka.

Sir mhughe lgta hai wo shyad aage jakar hum par zhute case kar sakte hai to sir future mai problem na ho aur judge ko pata chale ki in logo ne janbhujkar ye case lagaya kaun sa option legally sahi hai jo aage bhi kaam aaye section 9 case lagana ya simple notice dena lawyer se wapas aane kai liye.

Both the options are equally weighty. You can first issue her a lawyer's notice to return to her matrimonial home and then follow it up by filing a petition for restitution of conjugal rights against her. It will show your bona fide conduct.

1. No section 9 wala case file korna chaiye na lawyer ka notice bhejna chaiye,

2. Apko sirf unko thora time dena hai aur uska bad approach korna hai ghar wapas korneka liye,

3. Sec.9 ka case file paisa aur time ka waste hai,

4. Agar ap koi legal action lenge hai to apka bibi aur biagl ja sekye hai,

5. Apka dispute chota sa hai usko Vakilo ka chakkar me akar gambhir math banaiye,

6. Sidha jakar bibi ko mananeka kousish kijiye.

1. Sec.9 case ka matlab hota ki ap court se darkhast kor rahe hai ki ap ka Bibiko hukum diya jai ke oh apke ghar wapas aye,

2. Eh direction apko mil bhi haye to koi guarantee nahi nhay ki uh wapas ayegi aur uh wapas nahi aye to court kuch kar nahi sakta. Sirf apko divorce jaldi mil jaeha,

3. Bibi ko samjha bujha kor wapas laneka kausish kijiye pahle. usme ap agar fail ho jae to phir legal case ka bare me sochna.

First of all try to rope in elders from both the sides for reconciliation and amicable settlement.

If this is not fetching any fruit, then issue a legal notice and wait for her reply or response to return to her matrimonial home.

You may allow her sufficient time to respond to the legal notice.

If she is still not inclined to return, then you may file a restitution of conjugal rights petition under section 9 of Hindu Marriage Act, 1955 praying the court to direct to return to her matrimonial home.

This RCR petition may protect you as a shield in case she is planning to lodge false criminal cases agaisnt you in the future.

zhute case se dur nhi hai kyuki vakil bol rahe thai ki aajkal zhute case ka virod karna utna muskil nhi.

Bus mhughe wahi chinta hai dono mai se kaun sa option choose karo ki wo koi case lagaye to mera chuna hua kaun sa option aage jyda legally consider hoga section 9 ya phir lawyer simple notice.

First you issue a legal notice demanding her to return to the matrimonial home.

If she fails to respond or is not inclined to return then you may plan to file RCR case against her asking her to resume the conjugal life with you.
