• Property ownership after citizenship change

Hello lawyers, I am an Indian citizen and currently an NRI residing in Germany. I own a residential apartment in New Town, Kolkata, which falls under NKDA. I am in the process of applying for German citizenship. After obtaining German citizenship, I will surrender my Indian passport and apply for an OCI card.

My question is: After I become a German citizen and obtain an OCI card, do I need to change or update anything related to my property documents and in the government records regarding:

- The property’s ownership/title records
- NKDA mutation/Record of Title
- Property tax/assessment records
- Any other government records related to the apartment

The apartment will continue to be owned by me, and my name will not change. I would like to understand whether acquiring foreign citizenship and subsequently obtaining OCI status requires any formal changes, updation or notifications to the property records.

I would appreciate your response/advice. Thank You!

Under Indian property law and the Foreign Exchange Management Act (FEMA), a registered property title and Record of Title (Mutation) reflect legal ownership of the entity and not their passport nationality or residency status. As long as your full name remains identical on your new German passport and OCI card, your original registered Sale Deed remains fully valid.

You cannot and do not need to amend an already executed and registered Sale Deed. Under FEMA regulations, acquiring foreign citizenship and OCI status does not impact or invalidate the title of a residential property legitimately acquired while you were an Indian citizen.

NKDA assesses property tax based on the premise and owner of record. The change in citizenship does not trigger a tax re-assessment or structural modification. If your email address or primary phone contact changes upon transitioning your profiles, update your contact details on the NKDA / West Bengal e-District portal to ensure tax notices continue uninterrupted.

Update your KYC profile associated with your Permanent Account Number (PAN) to reflect your status change from "Resident/NRI" to "Foreign Citizen/OCI Cardholder". This ensures seamless tax processing and prevents issues when paying property taxes or filing Indian income tax returns.

If you decide to sell or rent out the property in the future, you will simply provide your German Passport, OCI Card, and PAN Card as identity/citizenship proof alongside your original Sale Deed.

After you become a German citizen and acquire an OCI card, you may update your resident/citizenship status and address in the house tax assessment records. There is no need to alter any other records.

- You do not need to change or update anything , and even no fresh mutation is also required even you get German citizenship.

- As per FEMA , OCI holders can continue to own residential immovable property, subject to the usual restrictions on agricultural land, farmhouse and plantation property.

Dear Client,

Usually, no change in ownership is required solely because you become a German citizen and obtain an OCI card. Your questions are answered in the following pointers:

  • Property title: Your ownership continues; no transfer or fresh registration is generally required.
  • NKDA mutation or Record of Title: Usually no fresh mutation is required solely because of change of citizenship.
  • Property tax: You have to continue paying it as before. If NKDA requires updated KYC/citizenship details, you may provide them the records.
  • Other records: You may update your PAN, bank account and KYC details wherever required after surrendering your Indian passport.
  • Documents: You may your original sale deed, old Indian passport, citizenship-surrender certificate and OCI card safely.

An OCI holder may hold residential property in India, subject to applicable Foreign Exchange Management Act (FEMA) rules. For further confirmation, you may obtain written confirmation from NKDA regarding any specific record-update requirement. You may contact a lawyer with relevant details.

Thank you for contacting us, if you have any further queries kindly do not hesitate to contact again. Thankyou.
