• Name discrepancy on the documents

Hello, 

I am a NRI, residing in Germany. Few months ago we are blessed with a baby here in India. On my passport my name is mentioned as just “RAKESH” and so all my documents in Germany are with “RAKESH”, while on my daughters birth certificate it is mentioned as “RAKESH UPENDRA PATIL” with a fathers-name and lastname included, for now I dont want to change or update any documents right now as I will be applying for her VISA. But is their a way, I can get any document which can say these two names are same and the document should be valid overseas.

You can get a one and the same name affidavit duly notarised in India stating that your name Rakesh and Rakesh Upendra Patil are one and the same.

If you are likely to use this document in a foreign country, you may get this document apostilled by Ministry of Home affairs.

Once apostilled, this affidavit becomes legally valid internationally.

If you are currently in Germany, you can directly execute the same affidavit at the Indian Embassy or Consulate there.

They’ll attest the declaration, and you can use it for your child’s VISA or passport application and for any foreign authority verifying your name identity.

This is often simpler than doing it in India because the embassy’s attestation automatically carries international validity.

Name Identity Affidavit (Affidavit of One and the Same Person)

This is the simplest and most widely accepted method.

Steps:

1. Draft an affidavit on non-judicial stamp paper (₹100 or ₹200) declaring something like:

> “I, RAKESH, holder of Indian Passport No. ________, presently residing at ________, do hereby solemnly affirm that my name appears as ‘RAKESH’ in my Indian Passport and as ‘RAKESH UPENDRA PATIL’ in my daughter’s birth certificate. Both names refer to one and the same person, i.e., myself.”

2. Get it notarized by a Notary Public in India (or at the Indian Embassy/Consulate in Germany, if you’re abroad).

3. Apostille or Attestation (for overseas use):

If the document will be used in Germany or another Hague Convention country, get it apostilled by the Ministry of External Affairs (MEA), India.

If it’s a non-Hague country, then get consular attestation through the embassy of that country.

If your passport shows your name simply as “RAKESH,” but your daughter’s birth certificate mentions “RAKESH UPENDRA PATIL,” you can easily prove both names refer to the same person without changing any documents right now. The best way to do this is to make a sworn affidavit or declaration of name variation, stating clearly that both names belong to one and the same person. Once the affidavit is notarised and properly attested or apostilled, it becomes legally valid both in India and overseas, including Germany.

You can prepare a short affidavit on plain paper or stamp paper (depending on where you execute it), mentioning:
“I, RAKESH, son of [father’s name], presently residing at [address in Germany], hereby declare that I am the same person referred to as ‘RAKESH UPENDRA PATIL’ in my daughter’s birth certificate issued on [date] at [place].
