• Change in DOB in CBSE records in Class 10th records, passed in 2018 from a School in New Delhi

Dear Advocate,
Greetings!!

I would like to discuss about a change in DOB in the records of CBSE required for my Son who has passed Class Xth from CBSE board - a school in Rohini, New Delhi in the year 2018. The DOB in original Hospital records, Birth certificate issued by municipal corporation, Adhar Card, Voter ID card, PAN card are all correct. Due to our negligence, the DOB was not corrected in Class Xth records. Now the passport authorities are asking for a correct DOB in the Class Xth records to make a passport.

We would like to get this date corrected in the Class Xth CBSE records. Please suggest how to go about it.

Make an application through your school to CBSE Board to correct date of birth in school leaving certificate 

 

2) most probably it would be rejected as application not made within period of 2 years

Practically, it will be very difficult (almost impossible) to get the DOB corrected in your 10th certificate now, unless you approach a civil court and get a declaratory order directing the Board to correct it.

The Passport Rules, 1980 (amended) allow the following documents as valid Proof of Date of Birth:

 Birth Certificate issued by Municipal Authority or Registrar of Births & Deaths

 Transfer/School Leaving Certificate of last attended school, with correct DOB.

PAN Card.

Aadhaar Card / e-Aadhaar.

Driving Licence. 

Voter ID (EPIC).

Insurance policy document.

 So, if your Birth Certificate (from municipality/panchayat) is available, that is the best proof. If not, Aadhaar/PAN/School Leaving Certificate can also be used.

For correcting your son's Date of Birth (DOB) in the CBSE Class 10 records, the process involves the following steps:

  1. Obtain a correction application form from the CBSE official website or the school where your son studied.

Since your son passed Class X in 2018, CBSE will not correct the DOB directly as the time limit is over. The only remedy now is through Court.

Steps:

  1. Collect all documents showing correct DOB (birth certificate, hospital record, Aadhaar, PAN, etc.).
  2. Prepare an affidavit.
  3. File a petition before the Delhi High Court seeking directions to CBSE to correct the DOB.
  4. Once the Court orders, CBSE will issue corrected records, which can then be used for the passport.

This is the only practical route now.

- As per law, there cannot be any correction in the academic certificate after 2 years maximum from the date of passing the same- Further, even if you will applied to correct the same before the CBSE after this period then it will not entertained.
