• Contradicting and conflicting answers for same legal questions

When asking a legal query/opinion (either offline or online), different advocates give different opinion, many-a-time 'directly conflicting and condraticting' answers for the same question. (To give an eg., whether police has powers in a matter, irrespective of experience, some advocates say yes,while some say no)

If so, as an individual, instead of blindly believing the opinion, how do one take 'informed' decisions when faced with such conradictions and lack of unanimity in some matters? 

Hope there won't be contradicting answers at least for this one :)

Every advocate has his own way of interpretation of law hence the opinion from one advocate to another may differ.

You cannot expect all the clocks to show the same time.

If you get an answer to your actual legal problem suiting to your situation you may go ahead with the suggestions received instead of probing into the reasons for some other advocate's contradicting opinion.

You cannot expect everyone to give an opinion suiting your requirement or to please you.

Besides there is no hard and fast rules that you have to go by the opinions of all the advocates or expect everyone to appease you.

The answers given in websites like this are based on the minimum information the querist would furnish and you cannot expect the advocates to know the complete background of the problems you face, hence the answers also will be in general, if some of the answers are not satisfying you then you can choose to consult an advocate either by phone consultation or visit the advocate in person at his office/chambers and discuss your actual problems and get proper legal advises accordingly.

No doubt, various proponents, including those who have long experience under their belts, may have opposing views over the same legal issue. It is not always that this is an indication of incompetence (at least it is not in some instances), but more a mirror of the law.

Why Legal Opinions Clash with Each Other?

  • Interpretation of Law: Laws (statutes, rules, precedents) frequently can be interpreted.
  • Vagueness in Statutes: Legal terms may be deliberately or inadvertently vague, and give rise to interpretations, which in turn create ambiguity in statutes.
  • Duplicity of Judgments: The judgments about higher courts are binding but conflicting decisions by High Courts on a more or less similar aspect of law may be a position. Even in the Supreme Court, one may get contrasting judgments or even the matter of interpretation of a law being interpreted by different benches a bit differently.
  • The Fact-Specificity of Law: Law closely depends on facts. The legal opinion may be similar but with a slight variation in the stated facts, the opinion may change in totality. One attorney will find a certain fact particularly important, and the other will reject the finding resulting in opposite conclusions.

The "informed" decision is ultimately based on you taking initiative to be involved in the legal process, to know whys of the advice, by choosing the lawyer and approach that makes more sense as per your knowledge of the law and personal intentions other than mechanically accepting an opinion.
