• Marriage dispute

Hi .I was married in Feb 2023, later we spend around 5 to 6 months and then started fighting , i felt like lot of harassment frm my wife and her family later we went with 3 panchayths...then since last March we are staying seperate .and went with around 10 panchayths .this year last month she filed a case on me and my family stating I had affair so tortured her..later I got call from women police station and attended 3 counseling sessions..and in the final it was ended with 14 lakhs settlement , out of which .Ci told me to pay 4 lakhs as intial amount as cash so that they will start divorce process , and we wrote agreement on April 30 , 2025 on stamp paper..which also mention gold and groceries have to return but not exact quantity..and may 15 2025 i paid them 4 lakhs( cash )and took a notarized reciept from them...after they took the cash they are falsely claiming the bracelt(20grams) put by my sister's during wedding and didn't go to advocated and signed on dirvice application.

They went to police station again said the same with ci, that we are not returning the bracelt , then we went nd showed the reciept to him..nd he had a discussion with them and asked them to bring the reciept, ..then after 3 days they also bought the reciept.

Ci called me today and saying they also bought the receipt and saying if giving bracelt nly they will go for settlement else they want to put case ah..

I am really not able to understand what to do now...

I have divroce agreeing which mentioned 14 lakhs ful settlement nd out of which 4 lakhs hve to pay on 15th may , that I paid and remaining in court on final judgemnt day

I have proof of amount paying on 100rs non judicial stamp paper nd notarized

I have original bill of gold too

I am not really understanding .if they are falsely clamining like this one after one when this process will over

You can inform police that they will keep coming with one or the demand subsequent to settlement also, hence you will handle them in the court  of law on all such further iossues.

If the police is threatening to register FIR you don't be worried about it, once a FIR is registered you can file an anticipatory bail application for all those mentioned as accused in the FIR.

As there is a settlement agreement and you have already paid an amount also  to his effect you will get AB without much difficulty.

You may not return any article to her in furtherance and categorically inform the police and also to their side that you will return everything in the court when the divorce proceedings comes to a conclusion.

You need not pay any further amount too till the divorce is granted.

Even if she withdraws her consent for mutual consent divorce during second motion, you can file a contested divorce case on the grounds of mental cruelty and also file a money recovery suit to recover the amount what you had given as advance towards the settlement arrangement

CI may be acting on their side in return of the graft received, you don't worry about the threats posed by the CI.

The CI cannot do anything even if a FIR is registered especially when you have obtained anticipatory bail, after that let the police file the chargesheet anytime before court, you can always challenge the same properly, in the meantime let she withdraw her cionsent for the mutual consent divorce you may file a contested divorce on the grounds of mental cruelty.

If you are pressured to pay the balance amount, you can categorically inform them that you will settle the amount befrore court at the time of second motion of the divorce case and not before that,.

Do not get scared. Even if you now return bracelet they would come with a new demand.

The first mistake you did was to go for settlement when only a normal martial dispute started. Your desperation for settlement made then more greedy for their demands.

Now get ready to fight the cases. Heaven will not fall nor you will be hanged if the case starts. After few months when they would realise that you are not going to settle at their terms, they would come forward to settle at your terms.

Good luck.

  • Send a lawyer-drafted legal notice demanding they honor the April 30 settlement (bracelet return or proof) and withdraw any fresh complaints.

  • File your divorce petition in family court now, attaching the stamped agreement and ₹4 lakhs receipt, and list the remaining ₹10 lakhs due at final hearing.

  • Keep all docs—agreement, payment receipt, gold bill, messages—and refuse any further cash payments outside court.

  • If they still stall, pursue specific performance or execution proceedings to enforce the agreement.

  • Don’t negotiate privately—route everything through your lawyer and court channels.

Dear Sir,

In the present circumstances, it is suggested that giving amoun in cash was fatal for you and you must have given the same by valid online transaction. However, you have got the proof of the same also. If the agreement was done and she is back tracking then you must file a case against her and the CI also for black mailing you. You must also inform the vigilance. Because in my opinion, giving cash has caused greed in them to put extract more in the name of bracet, etc.
