The testator can transfer the property by a bequest only to the property which the testator has clear and marketable title, if the testator is just a tenant then she cannot transfer the property on lease agreement to her heirs by a Will. 

It is not necessary that the lease deed should have entire details of the property and moreover at this stage the lease deed cannot be rectified hence you may not be permitted to add those details at this stage.

However if it is a leasehold property you can apply for rectification to rectify the  left out details of the property o the authorities concerned  after which you can have the complete details transferred to your name.

- Since, the mother has left a Will in the name of daughter , then she has right over the said property legally 

- She can apply for mutation of the said property in her name after submitting the death certificate of mother and copy of the said property papers. 

- However, the Revenue officer may ask for the Probate of the Will , hence you can file a Probate petition before the Court.

To transfer the lease deed of a Salt Lake (Bidhannagar) property in Kolkata from a deceased mother to her only daughter as the legal heir, the following steps must be followed:


  1. Obtain Legal Heir Certificate & Death Certificate – Get the legal heir certificate from the local authority and the death certificate from the municipal corporation.
