• Construction agricultural land

Hi, 
I have a 0.75 acre agricultural plot of land on which I intend to construct a farm house.
My queries are;
1. How much sq ft farmhouse can I build keeping the land as agricultural land.
2. Can I only convert 3000 sq ft of the 0.75 acres into NA land for construction and keep the remaining as Agricultural land.

the area of the agricultural holding on which one or more farm buildings are proposed to be erected exceeds 0.4 hectare but does not exceed 0.6 hectare, the plinth area of all such buildings shall not exceed 150 square metres; 

 

2) if the area of the agricultural holding on which one or more farm buildings are proposed to be erected is more than 0.6 hectare, the plinth area of all such buildings shall not exceed one-fortieth area of that agricultural holding or 400 square metres, whichever is less:

Farm house or farm building means a house attached to a farm and constructed in a portion of agricultural land used for the residence of the agriculturist or used for the purpose of keeping agricultural equipment and tethering cattle.

The house shall be used by the farmer for his own use and it .

The farm building or farm house so erected shall not be more than 10% of one's holding subject to maximum of such extent of land as may be prescribed.'

The farm house should be for the personal use only or for the benefits of family members, dependents and servants. 

Additionally G+1 floor is allowed in the farm house.

- As per law, an agricultural land cannot be used for residential purposes, and you cannot construct a house on agricultural land for residing.
- However you can construct farm house or temporary structure on agriculture land with the permission of the local authority/panchayat
- Generally to build farm house 4 % of total area allowed, and showing that you will keep your farm equipment, livestock, and needful things..

- You can apply before the Collector for converting the land into NA

In NA, land cannot be converted unless it is in a R zone. various rules apply to various zones. Additionally, there are various NA. See the local architectural or collector's office to ensure you are guided appropriately. Your land may already be under sale if it is a part of a plot that has been developed with roads. Applying to SDO is the process for converting land from agricultural to non-agricultural use. They will notify you of the formal fee that has to be paid once your application has been verified.
