• Behaviour of wife

I an 42 years old from Nagpur, i live in a rented appartment with my wife and a kid of 10 years.
I work from home as stock market trader. I pay all the expenses related to my house and my child.
I don't have any kind of relationship with my wife since we married except once we slept for child. She takes tuitions in my home and creates lot of disturbance for 5 hours during her tution. She doesn't contribute anything towards house or child expenses. She doesn't want to separate coz it is 2nd marriage for both of us. I am ok if she stays or goes. My query is "can i ban or stay her tutions legally on basis of disturbance and nucance, it disturbs my Son's study time / lunch time. He cannot bring his friends....thanks.... I want her to stop her tutions at my place. She is free to go out and work, i have never stopped her....

She is your legally wedded wife and has right to stay in her matrimonial home 

 

2) instead of you objecting let society object to taking of tuitions  in rented flat 

 

3) in alternative ask landlord to object carrying  on Tuitions in flat 

 

4) if you object wife will refuse to listen to reason

You can instruct her to either stop taking tuition in home or to rent a place outside to this purpose.

Since you are married to her and she is your legally wedded wife, you cannot ask her to leave the house, but you can take a new house start residing there but you would be required to pay the rent for this house too.

She is entitled to residential rights since she is still your wife.

- As per law, your wife has her residential right from you , and you cannot ask her to vacate the house on the ground of creating nuisance. 

-  Since, this house is on rent , then you can ask the landlord or any neighbor to lodge a complaint against her for creating nuisance and running the tuition in the residential house. 

- Further, if she not wanted to pass life with you , then you can take her consent for mutual consent divorce

- Further, If wife is not supporting her husband for the enjoyment of life and denying relation, then the husband can get divorce after filing a divorce petition before the court on this ground.

- Further, As per Delhi High Court, physical intimacy is an essential aspect of marriage and a wife's continuous refusal to have such relationship with her husband can be a ground for divorce,

- Hence, you can file a contested divorce petition before the court on the ground of cruelty .

You can’t stop the same legally till she is your wife. Only if she flouts any law then she can be made to shut the tution classes
