I'm Indian resident and unmarried women. I want to rent a property with my Christian American boyfriend/fiancee jointly. The rent agreement will have both of our names and the rent amount will be paid in 75 : 25 ratio. Majority of the rent amount will be paid by the American citizen and 25 or less will be paid by Indian citizen. Also I need the rent agreement to update my address on my documents for passport purpose. Are those type of transaction legal. Our backup plan is rent agreement will be only under my name but the full 100 percent of the rent amount will be transferred by American citizen to the landlord. Is it legal to do so and if we do that can we still prove that me an Indian citizen is lawfully renting the property even though full rent is paid by American citizen.

Renting a property in India as an unmarried couple is legal, but it may depend on the state and local laws, as well as the discretion of the landlord. You should be aware that while renting a property, you must create a rent agreement in the names of both parties and get it duly signed by them to safeguard your rights for the future. The rent agreement should also mention the ratio of the rent amount paid by each party and the mode of payment. You may also need to provide proof of identity and address for both of you, such as passport, Aadhaar card, PAN card, etc.
If you want to use the rent agreement to update your address on your documents for passport purpose, you should make sure that the agreement is registered with the sub-registrar’s office and has a stamp duty paid on it. A registered rent agreement is a valid proof of address for passport application.
Your backup plan of renting the property only under your name but having the full rent amount paid by your American fiancée may not be advisable, as it may raise suspicion from the landlord and the authorities. It may also create problems for you in proving your lawful tenancy and claiming your rights in case of any dispute. It is better to have a joint rent agreement with both of your names and signatures on it.
You can make rent agreement on both of your names, however don't disclose the rent ratio in the rent agreement. Rest of the things are fine.

There is no problem for you to rent a house on your name alone or with your partner name jointly as joint tenants.
The rental amount should be paid regularly without default and obtain a rental receipt for the rents paid.
Generally for address proof, the rental agreement will be considered as valid provide it was entered and executed on a registered deed.
- Being an Indian resident , you can enter into a a rent /lease agreement , and thereby you can also mention your boyfriends name as well
- Further , you can give one clause after mentioning that in the event of non payment of rent by you , your friend will directly deposit the same , or the rent will be paid through you
- Further, you can use this Rent agreement as address proof , however generally bank or many authority ask for a registered Rent Agreement.
