• I want to Update my mother's name in my passport but Supporting documents are not being enough.

In 2021, I found out my mother's name is incorrect in my passport. Instead of my mother's name its my Grandmother's name. I applied for update, and submitted Affidavit, Newspaper ad and my mother's adhaar card for verification. The RPO requested for my Birth certificate. All my original documents were made using an old birth certificate which had incorrect date. When I requested the hospital for the birth certificate they sent me a new updated birth certificate with new correct date. Due to this now my birth certificate and passport don't have matching birthdates. After this the RPO asked me my grandmother's proof , So I gathered adhaar card, ration card.
They also asked for my Father's passport. My Father's passport has incorrect name of my mother as it was made before marriage and the agent entered a random name in spouse name. There is no Marriage certificate. There is Ration card in which my mom and dad names are correctly added. Please help me. This is 2 year of me running and crying around the RPO with no proper help or guidance. I was supposed to join a college in foreign country where I had already paid the fees. I have lost a lot of money in between getting the fees back and all lost applications.

Your father should register his marriage and obtain marriage certificate 

 

2)then apply for updating your mother name in his passport 

 

3) you can then rely upon father passport for updating your mother name in your passport

- Since, your fathers passport also bearing wrong name of wife, then he should firstly apply for re-issue of the passport with the correct name , after submitting the proof of his wife documents like Aadhar card etc 

- However, there may be requirement for the marriage certificate for the same, hence they can apply for registration of marriage before the sub-registrar after submitting the correct proofs of name 

- As per law, the marriage can be registered any time even after the marriage . 

- Further , as your fathers name is correct in your passport , then the said marriage certificate can be submitted before the RPO for the said correction.

You have done all the things incorrectly due to your urgency at that time without realising the future consequences. 

Now what difference it is going to make with your grandmother's name appearing in the passport in the place of your mother's name.

You cannot give your grandmother's name in place of your passport  even by mistake in the application for passport.

Now you can approach court for relief of declaring your mother's name by filing a suit for declaration.

After that with the evidence of court judgment you can apply for reissue of passport, no doubt it will take a little time, but that is the only and permanent solution for this. 

At least now you do not resort to any short cut method.

If the authorities have denied your request you can file writ before High Court seeking direction from High Court to direct the passport authority to make changes which are possible. However, before filing writ petition all communication and written requests acceded by you to the passport authorities and reply to those communications are supposed to be looked in.
