Can a producer file a case against the director Who producer (me) gave a break for direction of movie, which happens to me my debut movie as an Actress as well. This was 4.5/5 years ago… due to Corona and couple other things project got delayed and got released recently. And in the process of release etc I came to know that the budget of the movie should have been around 3/3.5 Cr whereas my director got it upto 5.50/6 Cr. He hasn’t worked anything major yet his bank ac has 90L which are stuck in PNB…the director hired everyone known to him.. recently I came to know the Modus operandi that suppose “I have to hire X person and his fees is 10 rs, then he will ask X to say 15… payments were done in ac .. and later he would get it “… I asked him to show his ITR (which will clear the incoming payments parties name and thus shedding a light on the cheating) he hasn’t bothered to reply my message since 24 hours… I took loans for the project and he is the direct and indirect beneficiary of the project and YET he cheating and swindled around 1.5/75 Cr.

It is a case of misappropriation of funds by director
2) you can issue legal notice to director to furnish detailed statements of accounts for expenses incurred for the movie
3) ask for supporting bills
4) get accounts audited by CA
5) if there is misappropriation of funds you can file case of cheating and criminal breach of trust u der section 406,420 of IPC
If he has breached the agreement conditions you may sue him.
If you have evidence for misappropriation you may sue him.
You cannot take any action on the basis of oral evidences or on assumptions.

- Further, if there is misappropriation of fund, then an FIR can be lodged against the director for the offence of cheating and breach of trust etc.
