• How to gather info about a land and ancestral property

I am divorcing a narcissist who steals, cheats, and lies to everyone including the government and family for his own gain. 

First: During the marriage time, he took money from me through our joint bank account and bought a land in Kerala and said it belongs to us but he registered under his name and I don't know the exact address of this land except which city it is in now. Now that we are divorcing he is pretending that he does not own any land or property and claims only his dad does. I was not fluent in Tamil and so he handled the sale at the time. I need to know if he secretly purchased this land under his parents names and lied to me about it when we purchased it in 2020, if ownership changed, or if he is just pretending it was put in his Dad’s name. How do I find out the property details and worth of the land we purchased, and details of his other two ancestral properties? I do not have plot numbers. I have the address to the ancestral house and know the two land plots are within a ten minute drive that's all.

Secondly: Do I have any rights to the ancestral property through marriage?

You need to take search in sub registrar office to find details of the ancestral property 

 

2) if you have the address of ancestral property then search would reveal the name of person who is the owner of property

You cannot claim rights over his ancestral property at least not during his lifetime.

You can collect the details of his property from the village revenue officer under whose jurisdiction the property falls.

After that you you can obtain certified copy of the property documents.

The property purchased by husband in the name of his father or parents cannot be reclaimed as the stated transaction is barred by law so even if you get the details of payment trail even then you cannot claim it from husband's parents. As per law you do not have any independent right in the properties of your parents in laws and also in ancestral properties. You can merely claim money by recovery and can claim maintenance.

The acquisition of property by a husband in the name of his father or parents cannot be contested due to legal constraints. Even if the payment history is obtained, the property cannot be reclaimed from the husband's parents, as such transactions are legally restricted. According to the law, you do not possess an autonomous entitlement to your in-laws' properties or ancestral assets. Your rights are primarily limited to monetary recovery and seeking maintenance.

- You can enquire from the office of the registrar to know the details of the property , and even can get the certified copy of those documents in his or fathers name

-  Further, if you having proof of payment made to him for purchase a property , then you can be declared as the owner of the said property after filing  declaration suit before the court. 

- However, during the life time of your husband , you cannot claim any share in the ancestral property even in the divorce case, except you can claim alimony & residential right from him.
