• Appointment as BLO

I am semi government primary school teacher. I have some query regarding appointment letter as BLO as i got recently.
1) there are 6 teachers out of 12 in my school who's working as a BLO. Is there any limitations criteria in which authority cant appoint after somer percentage of staff appoint as BLO in one school?
2) the salary given to one is very low (6000 per year) according to work. In some cases one has to go for door to door work as BLO and they have 1400 people in their given area. What can be a solution for this?
3)my electoral officer assign teacher which out any proper managment or rule Like in some school there is no teacher working as BLO AND IN SOME SOME SCHOOL most of the teachers got this letter. Any solution for this ? On which one can take action?
4) some BLO got releiv from their appointment by political pressure or other kind of situation.
5) i have kidney stone and in a week i will have operation. May be doctor advised me to redt atleast 15 days after operation. How can i get legally permition of releif for this days??

1)BLO is a local Government/Semi-Government official, familiar with the local electors and generally a voter in the same polling area who assists in updating the roll using his local knowledge.

 

2) Under Section 13B (2) of Representation of People Act, 1950, BLOs are appointed from amongst the officers of the Govt. /Semi Govt. /Local Bodies. 

 

3) BLOs would continue to discharge the responsibilities assigned to them by their parent offices and would remain generally under the control of their administrative department, but they would not be transferred without prior permission of the DEO

 

4)BLOs are appointed under section 13B (2) of the RP Act, 1950 by the ERO after obtaining prior approval of the concerned DEO.

 

5)The duty of BLO should be made proportionately across all other cadres as far as possible

 

6)he existing rate of remuneration/honorarium to BLOs has been increased to a minimum honorarium of Rs. 6000/- per annum which means a hike of Rs 1000/- For a BLO a supervisor an annual honorarium is Rs. 12000/

 

7)any increase in salary has to be approved by election commission 

 

8) apply to your supervisor for leave . enclose medical certificate that you are to be operated for kidney stones and advised 15 days bed rest 

 

9) if any BL0 is relived from duty due to political pressure complain to election commission

The Booth Level Officers play vital role in preparation and revision of electoral rolls, for which they shall make a thorough study of the roll of the part assigned to them and shall make frequent field visits to the areas in the said part and interact with local people, particularly, elders and grass root level.

1. For appointing the teacher as BLO, certain polices will be adhered to as per the decision of the government based on the prevailing situation. 

2. A well defined system of incentives and disincentives for BLOs is being put in place.  The existing rate of remuneration/honorarium to BLOs has been increased to a minimum honorarium of Rs. 6000/- per annum which means a hike of Rs 1000/- For a BLO a supervisor  an annual honorarium is Rs. 12000/ .Besides, the Commission has also approved the proposal for a minimum amount of Rs. 1000/- per annum for a BLO for house visits made by him during the period of summary revision. Also that that BLOs should necessarily be sanctioned TA/DA, if they make travels outside their Polling Station areas for the purpose of training.  

3.  If there is a biased treatment by the Electoral officer to appoint the teachers as BLO, the matter can be represented to the District returning officer for direction to intervene in this attitude render equal justice to all..

4. The system is that some people with the influence of political people are able to manage, your complaint about this may not be entertained by the higher officer fearing repercussions.

5. You can apply for sick leave on the basis of the medical certificate including the treatment particulars and seek to relieve you.

By a decision in a writ petition the Rajasthan High court has passed an order as given below:

The provisions of Section 27 of the Act read as under :-
"27. Prohibition of deployment of teachers for noneducational purposes.- No teacher shall be deployed for any
non-educational purposes other than the decennial population census, disaster relief duties or duties relating to
elections to the local authority or the State Legislatures or Parliament, as the case may be."
A bare reading of the above reveals that the section, which deals with prohibition of deployment of teachers for noneducational purposes, by way of exception provides that the teachers can, inter-alia, be deployed for duties relating to elections to the local authority or the State Legislature or Parliament, as the case may be and it cannot be said that the work of BLO would not fall within the said category. In view thereof, the various plea sought to be raised in the petitions seeking mandate to the respondents not to deploy teachers as BLOs has no substance.

  7. Any salary increment must receive approval from the Election Commission.

  8. Request leave from your supervisor and attach a medical certificate stating that you require 15 days of bed rest due to a kidney stone operation.

  9. If any BLO is relieved from duty due to political pressure, they should file a complaint with the Election Commission.

  10. Wait for your appointment letter, which will include the terms of your appointment.

  11. Alternatively, before receiving the appointment letter, you can take medical leave.

Rs. Six thousand per year? Probably something is concealed. Govt is bound to pay minimum in terms of minimum wages Act. The salary and service conditions are not good. You can report the matter to labour department, ministry of social justice and welfare and can also file WRIT in high court.
