This Scheme shall be applicable to teachers and other academic staff in degree level Engineering Colleges and other degree level technical institutions including Architecture, Town Planning, Pharmacy and Applied Arts and Crafts institutions etc under the purview of AICTE.
Many employees and officers of Madhya Pradesh are not getting the benefit of 7th pay scale yet. These include the principals of non-government colleges. Now these principals, professors have approached the High Court. The High Court had issued orders to give the benefit of seventh pay scale to the principals, professors but it was not implemented.
After this, once again the High Court has shown strictness on the disobedience of the order. The High Court has issued a notice to the Higher Education Department and others and has summoned the reply. The High Court has given 6 weeks to file the reply. The court has issued a contempt notice to Principal Secretary of Higher Education in this matter.
However it may be noted that the above ruling was given to the government aided non government engineering colleges.
D.Y. Patil College Of ... vs All India Council For Technical ... on 7 September, 2018 bombay high court held that 6th pay commission recommendations are applicable to private engineering colleges also and college is bound to pay salary benefits to its staff retrospectively as per government resolution
2) private engineering colleges are are governed by the rules and regulations formulated by the AICTE, which is a statutory body.
3) AICTE has right to control the technical education, and in exercise of its power it can direct maintenance of minimum standard in those institutions which also extend to the infrastructure which would include the commensurating standards for teaching and non-teaching staff.
4) it is immaterial whether college receives aid from government or not
5) further Maharashtra State legislature is the competent body to deal with the subject. It did deal with the subject under Section 8(3) of the Maharashtra Universities Act. Section 8(3) clearly authorises the State Government to frame rules dealing with the service conditions of the employees (both teaching and non-teaching) of various educational institutions.
thank you sirs Does AICTE mandate 7th pay commission for private engineering colleges on this date?
Modi government has brought seventh pay benefits for all government as well as private sectors employees. It would be implemented from April 1, 2018 but i think it hardly implemented in private sector.
Because there is certainly * to not implement in private sector.
No. 7 th pay recommendations are meant for govt employees only and the same is not applicable on private colleges, however, authority of private college can adopt the recommendation.
Dear client,
As of my knowledge cutoff in September 2021, the 7th Pay Commission is applicable to central government employees, including those working in government-aided educational institutions. The recommendations of the 7th Pay Commission are typically implemented by the central government for its employees.
Private engineering colleges that do not receive any kind of government aid are not directly mandated to implement the 7th Pay Commission recommendations. The application of the 7th Pay Commission in private educational institutions, including private engineering colleges, is not universal and may vary depending on the specific policies and agreements in place between the institution and its employees.
Regarding the mandate of the All India Council for Technical Education (AICTE), I am unable to provide information on any specific updates or requirements after September 2021. It's advisable to consult the AICTE website or contact the council directly for the most up-to-date information on their policies and regulations regarding the implementation of the 7th Pay Commission in private engineering colleges.
