• Transfer to near hometown

I am a central govt employee posted at Thrissur Kerala. My home town is Khammam Telangana. My father is blind (retinopathy) due to diabetic and my mother is uneducated staying in remote village of Khammam. I brought them Thrissur to take care them. But they were felt lonely and sad since no one is there to speak with them in telugu. Further i were suffered with various minor diseases due to weather changes. Now they are thinking go back to my home town. 

My organisation has a branch at hyderabad, which is 100km to my hometown. If i get transfer to Hyderabad i can take of my parents nicely. Also Hyderabad has good medical facilities compared to Thrissur. They suffered a lot to provide education to me. Now its my responsibility to take care them.

My question is that is it possible to get transfer to Hyderabad? If yes, how to proceed.

Make application for transfer on grounds that you have old dependent parents to take care of 

 

in exceptional circumstances depending upon the merits of each case where it is considered necessary to accept such requests on extreme compassionate grounds, such transfers shall be allowed on deputation basis for a period three years subject to the approval of the transfer and transferee cadre controlling authorities.

Transfer is not a matter of right of an employee, so you can only request your employer authority for transfer citing the health issue of your parents in particular and you. So write your authority.

You apply to your department for transfer on medical grounds of your parents. Each and every Government department has a transfer policy and department usually consider such cases on humanitarian grounds during rotational transfer. In case, the department rejected your application for such transfer, you may approach Central Administrative Tribunal (CAT) Ernakulam Bench in Kerala or in Hyderabad through some advocate against such rejection of your representation.

It may sound harsh, but no government servant can demand a posting to a place of his/her choice as a matter of right however compelling his/her family circumstances be, as a government is an impersonal employer. In your case, submit a strong representation to your higher authority detailing the medical and physical conditions of your parents and attaching all relevant documentary evidence on hand. Transfer cannot be claim as a matter of right but on sympathetic ground. Give representation to the high authority. Make sure, your representation should be duly drafted reflecting your agony and need of transfer.

- As per rule , a government employee has not having his right to take a transfer to the location as per his choice , but after completing 55 years of age allowed for transfer as per his choice..

- Further, an employer of government of India, is having right to transfer an employee as per the administrative requirements at any place. 

- Since, there is provision of completing 4 years of service, then this rule shall apply for all the employee but according to the administrative requirement. 

- Since, you are having a genuine problem , then you can give an application after stating your conditions before the competent authority..
