• Unable to find my land purchased in 1990

We purchased a land in Nizamabad, Telangana in the year 1990 and there was no layout done in that area or there are any marked location. Now we want to sell the land but we couldn’t find it. We asked govt land surveyor and he said that the survey number where the land used to be is merged with other survey numbers. Some one built a large compound wall in the survey number where my land belongs and sold it to different people. I am not really sure if these stories are real or they are just unaware of the situation. What could the way to find my land ?

You should engage a competent lawyer to carry due diligence in respect of land/ property in order to ascertain the exact present position of the land / property. Only after ascertaining the position the other legal recourse can be explored.

Sale deed must be containing schedule mentioning survey number of plot ,boundaries of land 

 

2) you should ask govt surveyor to demarcate boundaries of land purchased by you 

 

3) if your survey number is merged the new survey number of your plot and detailed survey report is necessary 

 

4) tjen file suit to set aside fraudulent sale deeds

- If this property is registered in your name , then the details of the property would be mentioned in the sale deed including survey number 

- Further, if not traceable , then you can approach the registrar office of local municipal corporation office for the same. 

- Further, if some portion is sold by unknown person , then you can file a Declaration suit before the court for cancelling that sale deed in the name of purchaser.

You can ask the surveyor to give his report and not an oral submission about this.

Once you get the correct information from the land revenue department then you can file a suit for declaration of your title to the property, for ejectment of the person illegally squatting in your property  and for possession

In your sale deed there will be a complete description of the property in the Schedule, containing the survey no., boundaries on all the four sides, extent in acres/cents or sq. ft. and the measurements of the plot of land on all the four sides. From the Revenue authority (Tehsildar) you can very well come to know the present survey no. and the field map. Then you can easily locate your property. Take out an encumbrance certificate from the land registry and check if the property is continued to be shown in your name.
