It may not be considered as an illegal act if such transactions are not involved in money laundering illegal activities.

If your role is to earn your commission through legal means without promoting illegal gambling against the law of the land then this may not come under the purview of any illegal activity

Gambling is not legal in west bengal. Any kind of association is illegal whether partner or employer.

- Under the Public Gambling Act of 1867, it is declared as illegal and provides criminal penalties.

- However, in the matter of the Indian Poker Association versus State of Karnataka, the Karnataka High Court on held that playing skill games like poker in recreational club is permitted and no license is required for the same.

- However, as no Indian is involved in this game , then it will not considered as illegal , and the commission may attract taxation in India.

Dear client,

Gambling is a state subject in India, and the laws vary from state to state. While some states have legalized gambling, others have not. As far as federal law is concerned, the Public Gambling Act of 1867 prohibits running or being in charge of a public gambling house, and engaging in any kind of gambling activity in a public place.

In addition to the federal law, there are various state laws that regulate gambling. Some states have specifically legalized certain types of gambling, such as horse racing or lotteries, while others have banned all forms of gambling.

As an affiliate partner of gambling and casino sites, you are promoting these sites to players in India. While there is no specific law that prohibits affiliate marketing of gambling sites in India, it is possible that your activities may be seen as promoting illegal gambling.

It is recommended that you consult with a local lawyer to determine the specific laws in your state related to gambling and affiliate marketing.
