• Traffic police abusive words

Hi all

My husband was driving to his office today morning in Hyderabad and was struck in traffic. There was traffic SI who was helping to clear the traffic and he has asked my husband to move on further but he couldn’t do it faster die to heavy traffic and vehicles. The respective traffic police came near to the car and scolded my husband as Rascal why aren’t you moving the vehicle and he banged on the driver side car window glass
My husband said he is trying to go and again he said you Rascal
My husband was unable to take the words and stopped the car near by shop and got down from the car and went to the police and asked him the reaSon of scolding. 
That police got angry and he said i will scold like that and i will also write a challan to make you understand how difficult it will be with us. He wrote a online challan on the car which is parked rightly in the parking area 

We went to police station to raise a complaint and waited for half day but no use
They knew who is that person they called him but we dont know what ha. They gave us complaint receipt and said they will call if anything is required 

We wanted to proceed legally on this
Please advise 
We do not have any video proof or anything to prove that he scolded and banged kn the door
May be recorded in the traffic cc tv which we dont know

if no action is taken file complaint against SI with commissioner of police 

 

2) that car was parked in parking area but challan was wrongly issued and was abused by SI

Since you have already given a complaint, you wait for the police to take action on this, if you do not get any response within a considerable or reasonable time then you can escalate the matter to the higher police officer seeking his intervention to redress your grievance.

After that you can plan to escalate the issue through legal channel i.e., court as per procedures of law.

The procedure is that you have given a complaint to the police station complaining the attitudinal behavior of the erring police officer in the public which damaged the image and respect of the common man in front of general public.

If the local police station is not taking any action or a proper action then you can approach the top police officer of the city with a similar complaint seeking his intervention and to direct the concerned police station to inquire and take legal action as per law.

If this also fails to provide the desired result then you can approach judicial magistrate court with an application under section 156 Cr.P.C seeking direction to the concerned police to take proper legal action as per law on the complaint pending before them in this regard.
