• Money not refunded

I paid INR 8000 to a lady on 23rd October 2022, whose SBI account is in Jaipur thru UPI from ICICI Bank by mistake, as both names were same but little different UPI IDs. I am following up with that lady, ICICI Bank, RBI & PMO but no results.
In second case, I paid INR 9999 to a coaching institute at Delhi, on 12th Feb 2023. The course is yet not started and as I needed money, I asked them to refund my 9999 but they responded saying this course fees are non refundable.
My question to the responders is "can I lodge FIR to my local police station? If yes, will they have to come to Koparkhairne, Navi Mumbai Police Station?
Are there any chances that I will get my 18K back?
Is there any other way to get my money back?

You can file complaint against coaching institute before consumer forum seek orders to direct institute to refund your fees 

 

2) also seek litigation costs and compensation for mental torture undergone by you 

 

3)as far as money paid by mistake to lady is concerned file police complaint against her for failing to refund your money

The money sent to a wrong person may not be returned by the party if they don't wish to return.

If you can get the details of the person who received your money you can call them and request for returning it to you.

Police may not come to your rescue to help you recover this small amount.

 

About refund of the tution fee by the institute, if the instructions or rules clearly say that it is not refundable, then will not be able to assist in this regard.

You can send a legal notice demanding the refund of amount paid for the reasons you rely upon.

Sir, 

(1) Please write detailed letter again to Chairman, ICICI Bank. In this way, the letter would come to branch from higher authority and would yield result. 

(2) Please send legal notice thru an advocate calling upon him to refund the amount within 15 days failing which shall take up the matter with consumer forum. Thereafter, file a complaint thru local advocate with District Consumer Forum praying for refund, compensation for ment agony and harassment and litigation charges.

AS per law, A person to whom money has been paid, or anything delivered, by mistake or under coercion, must repay or return it.

And to recover money from institute, have to consumer case.

NO FIR in the matter.

- You can send a legal notice to that lady for getting the refund of the paid amount , and the bank is not responsible for the same 

- Further, it is well settled law that any service provider like the training institutes, educational institutes/schools or College /university cannot be allowed to forfeit the fees or consideration received in advance in case the student has not availed the service. 

- Further, the clause that the Course/Registration fee once paid is not refundable is unconscionable and unfair trade practice as well as voidable and therefore not acceptable.

- Hence, the said coaching is under legal obligation to refund the said amount paid by , as you have not taken services 

- You can send a legal notice to the said coaching Institute for getting refund , and if no response then file a compliant before the consumer forum of your area against that coaching.
