• BTech degree validity from IASE University 2004 batch

Respected Sir / Madam,

After completing Diploma in Electronics and Communication Engineering, I have taken admission in IASE University distance education and passed B.Tech Electronics and Communication Engineering 2004 to 2006 batch. I have all taken all transcripts and provisional degree certificate from university and working in IT company for the past years. 
Now, when I approached university for my degree certificate, the examination team responded saying as per the supreme court judgement...in Background Note:

"In pursuance of the orders of the Supreme Court arising out of special Leave Petition (C) Nos. [deleted]/2012 the Hon’ble Supreme Court inter alias has directed (under para 46 of page no.106 and para 47page no.107) that the degrees in engineering awarded to students who were enrolled during the academic years 2001-2005 with the following deemed-to-be universities shall stand suspended till they pass examination under the joint supervision of AICTE – UGC.
(1) JRN Rajasthan Vidyapeeth, Rajasthan
(2) Institute of Advanced Studies Education, Rajasthan (IASE)
(3) Allahabad Agricultural Institute, (AAI)
(4) Vinayaka Mission’s Research Foundation, Tamil Nadu, (VMRF)"

I however belongs to 2004 batch, I was eligible to take AICTE exam in 2018 as per judgement but not aware of such case or things going about. As I have passed and completed PG and was working for all these years. the AICTE says there wont be any exam conducted who missed in 2018 and no response at all from them. I am worried really on my education qualifications and working in job.

1. What is the status of my Post Graduation MTECH from another recognized university which I have completed after my B.Tech in 2011? the university I have done MTECH is recognized and no issues on the validity by UGC? Is my PG also void or safe?
2. What are the options I have to get my BTech validated in the above scenario?

As my MTech is valid from reputed university, will this be fine even If my AICTE EXAM is missed?

File petition in SC to permit you to take the exam under supervision of ACTE 

 

2) that you were not informed that your degree was suspended.no intimation  was given by ACTE or university to students who passed out of IASE 

 

3) that your career would be adversely affected if your BTech degree is not valid

You have not been informed by the university that your B Tech examinations is not valid until you obtain a certificate from AICTE and that you had to appear in the examination held in the year 2018.

But the fault is on your side too that you have not taken efforts to obtain the degree certificate after completing the examination at least after obtaining the provisional certificate.

Well you may approach supreme court itself seeking direction to AICTE to recognise your B Tech examination on the basis of your course that you have completed as well as passing the requisite examination in the course. 

If you were permitted to pursue the  M Tech course and were allowed to appear in the M Tech examination considering the B Tech as the requisite qualification, it is evident that you are very much eligible for obtaining the B Tech degree from the said institution.

You may have to fight it out legally.

You can implead your institution also as necessary party in the proposed writ petition that is suggested to be filed before supreme court

The status of your Post Graduation MTech from another recognized university is valid and secure, as it has been recognized by the University Grants Commission (UGC). No issue of validity has been raised and you can rest assured that your qualification is valid and accepted.

In order to get your BTech validated in the above scenario, you may approach the Supreme Court of India to review your case and consider granting you an exemption from taking the All India Council for Technical Education (AICTE) exam. Alternatively, you may contact the AICTE directly to determine if they are willing to provide you with an exemption from taking the exam. Additionally, you may approach the University to see if they can provide you with an alternate option to validate your BTech qualification.

It is not known what decision will supreme court take on your writ petition, however you may put up a strong pleadings convincing the court that you are aggrieved due to the said decision and request the court to give you remedy for this.
