The parking space within the housing society complex actually belongs to the housing society/association, therefore the owner members cannot sell or let their allotted parking space on rent.
The agreement to let out the parking space on rent is an illegal act and invalid in law.
What others do may be illegal but if you follow the steps you too shall be deemed to have committed the same offence, hence it is advisable that you e cautious over the issue.
Car parking falls under the ambit of common areas, and as such, no resident can claim any exclusive right. Entering into any rental agreement is unlawful. You may challenge such an act.
Dear client The legality of renting out a parking space in a cooperative housing society in Maharashtra is governed by the Maharashtra Cooperative Societies Act, 1960. Whether such an agreement is legally valid or not depends on the terms and conditions mentioned in the agreement and whether it is in compliance with the provisions of the Act and the rules and regulations of the society. It would be advisable to seek legal advice from a qualified lawyer in this matter to ensure that you are not violating any laws or regulations. Additionally, it is also important to ensure that you have obtained the necessary approvals from the society before entering into such an agreement and handing over a copy to the society
