My flat was rented with agreement for 2 years.
At end of contract period discussed with tenant regarding new contract and finalized the rent for new agreement. However tenant is unnecessarily delaying the new agreement registration.with time to time follow up they are delaying it. Rent agreed was 32k but they send only 26k. New agreement is not yet registered. As a owner what can I do now

Issue legal notice to licencee to vacate premises as period of agreement has expired 

 

2) if he refuses to vacate file suit for eviction of licencee 

 

3) also claim penal rent as per terms of your agreement on account t of his failure to vacate premises on expiry of agreement

You can orally inform them with a deadline time for registration of the new rental agreement, if he is not turning up you can issue a legal notice to vacate the premises as the previous rental agreement has since expired. 

If he fails to vacate the premises even after that you cn file an eviction suit to evict him from the rented premises.

- As per law, in the absence of a rent agreement , the tenancy will be termed as month to month basis , and the tenant is bound to pay the rent regularly 

- If the tenant is not paying the rent as agreed , then you can send a demand legal notice to him for getting the same , and if there is no response then you can file an eviction petition before the court .

Dear Client,

A rent agreement provides tenancy for a short period, which is later renewed after the completion of the period. Generally, a landlord and a tenant make a rent agreement for a period of 11 months, with an option for a periodic renewal. Since the current Rent Control Act is largely in favour of tenants but only applies to lease agreements of at least 12 months, establishing an 11-month pact helps landlords to take pre-emptive measures for eviction. It is because of the archaic nature of this act that the new Model Tenancy Act 2019 has been recommended.

As your rent agreement has expired, the concept of notice period also may not apply. Hence, it is perfectly lawful for the owner to ask the tenant to vacate the premises.
