Send legal notice and approach consumer court
The builder is not answering to our requests of how the wall would be demolished which is a danger to my family members which faces our backside. What legal information shall we convey him in order that he should take some action.
It seems difficult, only I want some legal message to be conveyed to him initially.
Issue legal notice to builder to demolish wall as it is safety hazard
2) enclose report of structural consultant that wall is in precarious condition
The wall that is precarious and posing danger to the safety of the inhabitants of your house is a very serious issue.
You can either issue a legal notice to the builder to remove the wall which is a safety hazard or make a complaint to the local civic authorities expressing your fears in this regard with a request to initiate immediate action to overcome the problem.
Then you can issue a legal notice to him conveying your concern in the regard and instruct him to provide relief to your problems.
First you can make complaint in consumer forum and RERA.
Plus for family protection which is threat from builder file FIR against him u/s 503 of CrPC.
- You can send a legal notice to the said builder regarding the possibility of fall of the said wall
- If no response , then lodge a compliant before the MCD head office for the same after mentioning that the said Wall can be collapsed suddenly and which cause loss of life and property including your family.
There are two possibilities. One is civil and the other is criminal. a legal notice should be sent stating to provide necessary information else any further demolition would make the person liable. For civil, write negligence, causing grievous injury, and destruction of property, all of which are compensable under tort law. In the criminal section from the IPC for his negligence can be used. There is also a possibility of getting a preliminary injunction mentioned in the specific relief act.
