Is there any latest G.O. Ms. related to Government land assigned to Ex-serviceman and Freedom Fighters in Andhra Pradesh State..I know one G.O. Ms. No. 307 Dated 06.06.2013 but I need latest one ?

The GO what you have referred to in your post pertains to the alienation conditions/relaxations of the conditions of the assigned lands to the ex servicemen and freedom fighters. 

 

However there are various rules/GOs of AP State pertaining to allotment of house sites and other welfare measures to Ex-servicemen and few among them are:

Government of Andhra Pradesh vide G.O. Ms No. 1241 dated 27 Oct 2008 of Revenue
Department issued Orders for Allotment of House Sites of 175 Sq Yards to each Exservicemen and Widows as a Welfare measure.

 

Allotment of house site of 300 Sq yards at the Headquarters to the war widow/dependents
of defence personnel killed in action and war disabled Ex-servicemen of other than OP VIJAY
vide GO MS No 92 of Home(General. C) Department dated 30 May 2005.

 

In case of Armed Forces Personnel Killed in Action/Disabled in Action in “OP VIJAY”
whose native place is a rural area, the allotment of house site would be upto 300 Sq yards at
the native place. In case of the native place being in urban areas, in addition to house site
allotment facility already available under the existing rules, out of turn allotment of one
residential flat/ house in an APHB project would be made available on cost basis at the rate
applicable.

 

Exemption from property tax for one house/property of Ex-Servicemen/widows/serving
personnel when it is occupied by the Widow/Ex-Serviceman and by the family in case of
serving personnel for their self dwelling purpose. (Auth : In Municipal Limits GO Ms.No.83 MA,
dt.[deleted] of MA and UD (TC) Dept & In Gram Panchayat areas GO Ms No. 371, dt 20-11-
2003 of PR and Rural Development (PTS-III) Dept.

 

The State Govt have reserved houses constructed Andhra Pradesh Housing Board
(APHB) to Ex-Servicemen, widows and serving defense personnel on cost basis as under :-
(a) HIG-5%
(b) MIG-5%
(c) LIG-2%
(d) EWS-4%

As per G.O.Ms.No.279, dated 04.07.2016, the Government clarified in sixth para of G.O as follows:
(i)The procedure of issuing „NOC‟ shall be dispense with. There shall be no need for obtaining NOC in all cases of assignment of Ex- servicemen and freedom fighters in which a period of 10 years has expired and there is no dispute on the land with the Government.
(ii)All such cases without dispute shall be deleted from the prohibitory list under Section 22-A of Registration Act, 1908 and furnished to the Registration Department.
(iii) In respect of cases in which there is a dispute with Government about the genuineness of the assignment or otherwise a list of such cases shall be prepared by District Collector and furnished to Registration Department by following the procedure under Section 22- A. The Sub-Registrar shall enter the details of such disputed lands in the online records deleting all other lands in which there is no dispute.

In view of guidelines in G.O.Ms.No.279 dated 04.07.2016, ‘No Objection Certificate’ is not required for sale of land, assigned to Ex-servicemen, if necessary, on the application of this petitioner or otherwise intimate the same that no ‘No Objection Certificate’ is required to sell the property, in view of the various G.O.Ms.No.279 dated 04.07.2016 discussed above.

By GO  Ms. No.1117, Revenue (Assn.I) Department, dated 11.11.1993.orders were issued directing that the Exserviceman are free to sell away their assigned lands after a period of ten years in partial modification of the orders issued in the 1st read above and all other conditions specified in the G.O. 1st read above shall continue.

 

 

In the G.O Ms. No. 1045, Revenue (Assn.I) Department, dated 15.12.2004 orders were also issued according permission to the effect that the Freedom Fighters are free to sell away their assigned land after a period of ten years.

 

As far as NOC to be given to the allottees  for alienation, there is an order passed by the statutory authority with guidelines that have to be followed scrupulously before granting permission or NOC for alienation.

Dear Client,

Lands assigned in Andhra area are heritable but not alienable, G.O.Ms.No.1142, dt.18.06.1954. Ex-servicemen are free to sell away the assigned land after 10 years,G.O.Ms.No.1117, dt.11.11.1993.
