Once it's cancelled by DRO. You can approach with its order to police and get them evicted
I have a property land located in Chennai (Tamil Nadu) India a portion was grabbed they stole from my pasta made a fraudulent sale deed I have written numerous officials FIR, RDO, Tahsildar and others The DRO is cancelling the Fraud Sale Deed I now need to get my Pata fixed I have approached the RDO. What are the steps to take once I have DRO order. How can I physically get the people to leave my property break wall and what are the Pata Cancellation steps. Do I need to apply for a new Pata or can I revert to my original? Can the other parties appeal the DRO & RDO?
What about the Pata where they stole from they took some from the physical property and took street and splay area as well they stole from original Pata 2.22
Please note that DRO and RDO are Revenue Authorities. They are competent to issue a 'duplicate' patta to you after due enquiry. You need to file a police complaint about the loss of your original patta and also a newspaper advertisement. If you apply to the Revenue Authority with proper records, they may entertain your request on merits.
If no appeal is filed offer would be final and binding
2) if the trespassers refuse to vacate you have to file suit for eviction
3) your patta would be restored based on DRO orders
First of all you have already got an order from DRO. It is not known that how the DRO passed an order cancelling the sale deed, because only civil court can cancel the sale deed obtained fraudulently
Anyway, since you have already approached DRO and obtained an order in this regard, you can give an application to the same authority to direct the Tehsildar to reissue patta with proper details of the proeprty that is on your name by the virtue of the registered sale deed on your name as well as on the basis of the details of the original patta before this fraud took place.
Once the patta has been restored to your name, you can either approach the court with a suit for ejectment and possession of your property or approach police with a complaint for land grabbing offence agaisnt the offenders.
If they have occupied your property without any authority or rights then you should have approached court with a suit for ejectment and return of possession of the property they encroached.
Besides you can very well give a complaint for land grabbing offence also
