Lawyers are available now to answer your questions.
how much time would high court takes to dispose this case considering senior citizen How to take max time in this case as a tenant
It would take at least 3 years for disposal of case
2) disposal of case depends upon pendency of cases in HC
Senior citizen can seek expedited hearing
however even for senior citizens number of cases are pending
Jurisdiction comes under High court of Karnataka
- Even the eviction order passed by the district court , then also the owner cannot evict before 6 months period from the date of eviction order.
- Further , you will have right to approach the High court against the eviction order.
- Further , for taking the possession of the tenanted premises , the landlord will have to file Execution petition before the said court.
- Hence, eviction will take time to dispose off.
If the appeal is filed before high court, it may be disposed within two months from the date of it being taken on its file.
As a tenant you first file the appeal and get a stay order irrespective of the fact that the owner is a senior citizen, after which you can be in touch with your advocate for further conduct of the case as per your desire.
If the appeal is filed before high court, it may be disposed within two months from the date of it being taken on its file.
Whether Karnataka high court or any other appellate court, for disposing appeal is not inordinately delayed, hence you should be watchful about it.
