• Change of hissa number by the Revenue Inspector

Dear Lawyers,

From a mutation register entry from the year 1984 in Karnataka, I observe that One Revenue Inspector has approved the change of hissa number from 45/1 to 45/6 in one village. The comment written is " The 4 chakkubandis (boundaries) written in the title deed can be matched to the land in 45/6. So , khata is done for 45/6. "
Please let me know is this a valid change? If yes, Was there any government rule which allowed the village accountant to do this mutation entry and Revenue inspector to approve it?
We want this as proof to convey that our survey number change from 45/1 to 45/6 is done officially by the government authority. Can this be used in the court?

It is valid change

you can use entry in revenue records to prove that survey number has been changed by the revenue authorities

1) in reply to court query you should rely upon changes made in your neighbours khata number and approved by revenue inspector

2) get your change in khata number approved by revenue inspector

Yes it can be used in the court. You need to examine the witness for proving the same in court

If the revenue department has done re-survey of the property as per procedures of law and on the basis of the recommendations of the revenue inspector if a fresh survey number was allotted by giving a reason thereto then it can be held as valid, hence you can cite that as a reason to effect the changed survey number  to the property.

The revenue records held by the revenue department as found in the mutation registrar will be a substantial evidence to present your arguments in this regard.
