We ( our association have purchase land from farmer who produce 7/12 certificate. now one of far distance relative of seller apply in collector office that i am entitle to get share in land and seller have illegaly sold land as they are not genune farmer. what we can do as purchaser ?
let me repeat my question to give correct fact. we ( association register in trust ) have purchase adjoining land of our land from party who show 7/12 certificate as farmer. after documentations formality over and posses the land with us. Now unfortunately one old lady related to seller ( claim as aunty) apply to court that she is also hair in land and apply to collector that my " my relative are not real farmer and not qualified as seller " Now what is our roll to become land owner as clean and we can proceed to develop property ? --------Thanks ------- Pankaj

2) further if seller has name in revenue extracts he would be regarded as farmer
there must be indemnity clause in your sale deed wherein seller indemnifies you in case any cllaims are made
you can sue the seller to recover your money with interest
If the seller is not having proper or marketable title to sell the property in favor of the buyer then the sale deed as well as title to the buyer is defective and the sale deed itself would be invalid.
You may have to file a criminal complaint against the seller for cheating you and try to get back the money and can even execute a cancellation deed.
The complaint given by the said lady itself is not a decision or rendering the sale as invalid.
Whether the seller was a farmer or not shall be decided by the authorities concerned based on the documentary evidences he may submit before the authorities on being summoned for n inquiry if the authority is summoning him on the basis of the complaint.
You may have to participate in the inquiry session and explain your stand as well as your side justification
If you had purchased the property without obtaining proper legal opinion then all such problems have to be faced.
