D. M. Says he can't do partitions because of Tukda dharo. I think because my land is in new T. p scheme and under municipal limit. This law can't be applied to my land. So what are other legal reason of tukda law I can give him with proofs thatt this law can't be applied to my lands. Please give me clear reasons where this law can't be applied and why?
When court has passed preliminary decree for partition it would appoint court commissioner for carrying out partition of land
2) required documents
DM has to comply with court orders for carrying out partition of land
as far as applicability of tukda dharo is concerned better contact a local lawyer
If you state that you have got the share of property by a partition, you may have to produce the registered partition deed to prove the acquisition of your share in the property vide the said deed.
If the cosharers agree for an amicable partition among yourselves, then you can draw a partition deed mentioning the allotment of schedule of properties to each share holder as per the agreed terms and get the same registered.
Thus the proof of partition by a registered document would be an evidence to prove your claim.
If the piece of land held by you cannot be proved to have been partitioned in your favor then you may have to look for ways to prove that this proeprty belongs to you.
If the local laws do not permit to partition a small piece of land then you cannot claim it as a right.
You may talk to the cosharers and try to get the entire proeprty on one's name so that this will not remain as a small part of the land partitioned.
