• ADR mutual consent divorce

My divorce is at final stages
first motion done 
second motion appearance done
 and mediation attended and all went fine by both parties

Now case status says ADR 

hope its the final appearance 

For the final appearance before the decree what are the process and formalities? before divorce decree is issued

Both Petitioners have to file affidavit that there is no reconciliation possible and that marriage had broken down 

 

family court would pronounce judgment dissolving marriage on next date

- If  the statement of both the parties recorded in the second motion , then the matter is fixed for passing the judgment .

- Further, as the status says ADR i.e. to settle the dispute out of court , it means the statement has not been recorded due to some disputes ,and hence the next date is not for final decree of mutual divorce .

In the final hearing, both the parties  to the divorce case have to let in their evidence in the form of affidavit sworn  before by stepping into the witness box.

The court may pass the orders after this process is completed.

After the process of letting in evidence by both the parties, the court will fix a date to pass the orders/judgment.

The parties appear on the date of the second motion and the judge asks some formal questions so as to be sure that the parties are willing to be divorced.
