• OBC non-creamy layer for married woman and no parents

I am Married woman with BC B certificate. I am a private tutor and my husband is unemployed from past 3 years.

Now I want to apply OBC non creamy layer certificate. I am a single parent child and my mother recently expired. I am part of ration card with my mother and do not have any other documents either pancard/aadhar/ration with my husband details.

How should I proceed with the affidavit and on what basis I should take my obc NCL certificate. as it is clearly mentioned husbands income is not considered can I produce my mother death certificate and my income proof ? Or what should I do

Your income is not considered for issue of non creamy layer certificate 

 

2) further husband income is not considered 

 

3) Obtain a blood relative’s caste certificate, if the father is deceased

 

4) enclose death certificate of deceased parents

- As per law your parents income will be considered for OBC NCL , and not the income of husband. 

- If your parents have already died then mentioned in the form for their death , and hence your personal income will only considered . 

- You can mention in the affidavit that your parents have already expired and your annual income is below 8 lakh , and further your total income from all sources is less than the limited income.

What is Your father last 3 years gross income ?

 

you can enclose death certificate of mother 

 

you have to mention your father last years income as mother had not divorced your father

- If your father is working then you have to mentioned his income details , otherwise in the affidavit you can show that fathers income is NIL , mother -expired , and your income from all the sources is Rs.......,

You may have to apply for OBC NCL certificate on the basis of your parents' income alone.

If your father is alive then you can rely upon his income to get the desired certificate.
