Dear sir , [deleted] crime done , but so many struggle with high Officer told them police FIR lodge but [deleted] , now today they file to a Court ' B ' report , I gived DVD copy of all evidence .what I do next.

Hi, The court will give an opportunity to file objection to the B Report, So engage the advocate and contest the case. If the court feel that you have sufficient evidence to prove the case and it will direct the police to file charge sheet.

2)if FIR is lodged it is criminal case not civil case for divorce

3) if B summary report is filed ie closure report you should file protest petition and seek orders to direct police to carry out further investigations

If closure report is filed you can file protest petition to challenge the FRT.

Once that is filed the court will hear you again and may consider directing the police to make further investigation or treat your complaint as petition of complaint and start case u/s 200 crpc .

So meet your lawyer and instruct him to act accordingly.

Is your wife working ?

Courts generally award around one third of net income as maintenance

4) if you have filed appeal against trail court order of maintenance court would be reluctant to grant stay unless you comply with trial court orders

5) SC would not intervene and stay trial court orders unless you comply with trial court order

6) your wife can take out execution proceedings to recover the arrears of maintenance

In maintenance case involving paltry sum of Rs.4000 pm no court would grant order of stay.I am sorry to inform this.

Even if stay is granted that would be conditional on either to c;ear all pending arrears or strat making payment from the day of order.

If the police is not conducting the trial properly and is trying to save the interests of the complainant and if you are the accused. you may fight it out in the court through your advocate on the basis of documentary and other evidences in your side. ,

in District court they gived judgment 4000 each , after I go Karnataka high court RPFC 101 /2017 BUT they not gived IA STAY IS Pending . What I do next , now they r going to 125 (3) crpc to recovery maintenance . What I do am not able to give that much money , if I filed to give money what is the punishment . Please tell me briefly are how I escape . Or can I go SC court for STAY.
