• Legal opinion

I have already received legal opinion on my quarry and submitted on Dated: [deleted] at 19:35 hrs with the remark ‘Ask another question’ . The gist of legal opinion is as under-
1) Only the builder is required to pay additional land compensation.
2) Circular appears to be in contravention of Allahabad HC in directing sub lessee to pay compensation.
3) you can issue legal notice to GNIDA to with draw the circular failing which contempt of court proceedings would be initiated against them.
In continuation of providing of legal opinion as stated above I would like to have further legal opinion on the word ‘IMPOSITION’ used at many places of my sale deed at the time of purchase of FLAT from the Developer / Builder. I would like to know about this in relation to judgment of Allahabad High Court dated [deleted] on ADDITIONAL LAND COMPENSATION of 64.70%. Though the word ‘IMPOSITION’ was used at many places in sale deed , the relevant paragraph of my sale deed on which I require legal opinion on the word ‘IMPOSITION’ is as under-
“That the Allottee(s) / Sub-Lessee shall be liable to pay on demand municipal tax, property tax, water tax, sewerage tax, other annual rent, taxes, charges, levies and impositions, levied by the Lessor and/or any other local or statutory authority from time to time in proportion to the area of the said Flat/Dwelling Unit from the date of allotment of the said Flat / Dwelling Unit by the Developers.”
In my case, Lesser is Greater Noida Authority, Lessee is Stellar Parks Pvt. Ltd. (Developer / Builder and Sub-Lessee is Purchaser.
I am paying the requisite fees but if it is in continuation the paid fees may be refunded
Submitted and Regards.

You may have to approach the authorities concerned for refund of the charges paid by you with reference to the judgment in this regard.

If you do not get proper response from the concerned authorities you may take the assistance of a local lawyer and proceed legally as suggested.
