• A notary lawyer is threatening my widow mother and asking for extra money

We registered a land and the lawyer asked for (7+1) % where 7 % was court and stamp duty fees and the 1% is his fee.He agreed upon all these things but now he is demanding more than 2 pc and is threatening my mother that he will tear the documents and level false cases against us. We came from the registrar office without the documents.Please help

If the lawyer is threatening with such illegal acts you may prefer a complaint against the lawyer before the bar association to which he is attached.

Alternately you can give a complaint to the bar council of the state against the advocate for his actions of blackmail and extortion.

Since  it is very lengthy procedure, you may look for an amicable solution with the lawyer by negotiating the fees. .

File police complaint against lawyer for extortion 

 

if you have obtained in writing from lawyer fee structure enclose said quote to your complaint

The registrar's office is duty bound to hand over the original sale deed only to the buyer or his/her authorised representative, and to no one else. Please contact the registry and request them not to deliver the original document only to you and not to any other person. If you have inadveretently authorised your lawyer to collect the document on your behalf, please cancel the authorisation at once and inform the regsitry in writing about it.

- The said act of notary lawyer is against the law, and your mother can lodge a compliant against him before the BCI and also with the police for the offence of threating and misusing the document

- If , there is an agreement between your mother and the lawyer then you are bound to pay the same , otherwise he cannot threaten to tear the papers as this is against the ethics of advocate act.
