  • Kapil Chit funds not returning my money even after maturing of my Chit

I opted for 5 Lakhs kapil chit fund and paid entire money for total duration.
My fund got matured in the month of April 2021. Its been more than 3 months and they just postponing saying due to COVID asking for more time. Till now they have not deposited the check and not received the money yet. 
From last one month every week they are saying next week. 
How do i file FIR on this.

- You can lodge a compliant before the police for the offence of fraud and breach of trust , and if no response then send the compliant to economic wing as well. 

- Further, you can send a legal notice to refund your matured amount. 

- If no response then file a compliant before the Consumer forum on the ground of deficiency of services and ask compensation for mental harassment with the entire amount.

Dear Sir

It would be advisable that first you send a legal notice insisting that you are paid the money that you are owed.

After this you can file a recovery suit before a court which will force them to pay up.

Send them a legal notice if not paid file cheating complaint against them. You can also approach consumer court if the said company is service provider

- Legal notice should be send through an Advocate via email, by post .

- However, before sending the legal notice you can send him personal notice that in the event of non refund , you will be constrained to take legal action against the company .

you can lodge a criminal complaint against the chit funds company with the local police for the offences of cheating and breach of trust including criminal intimidation and high handedness.

You can first issue a legal demand notice demanding the maturity amount of  the chit fund, if they fail to respond or comply with the demands made, you may even file a money recovery suit with the proper civil court.

You have to raise objection and complaint with the concerned licencing authority and request to investigate and to suspend their license. Secondly file FIR with police, better few other persons facing similar problems then your case will be strong.
