• Is there any provision that can stop my parents from calling my boyfriend's parents and harassing?

Hello,

My parents who are against my relationship have been calling my boyfriend's family and harassing them.
I believe there is possibility of physical danger as well. Is there a provision to safeguard my boyfriend and his family.

Boy friend parents can file police complaint against your parents under section 504 of IPC for acts endangering peace

Only your boyfriend and his parents can take action against the harassment. They can file a complaint at the police station. Inform them if any danger or threat exists in their life

as per the sec.504 IPC , Whoever intentionally insults, and thereby gives provocation to any person, intending or knowing it to be likely that such provocation will cause him to break the public peace, or to commit any other offence, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

Dear Madam,

1. Action can be taken only by your boyfriend or boyfriends parents

2. They can file a complaint in the nearest police station

3. They may file a complaint for criminal intimidation under CPC 

4. They may also file a complaint for assault/battery under the Law of Torts (if they are physically hurt)

The affected parties may lodge a criminal complaint with the local police venting out their grievances, apprehending their fears and seek protection as well as proper legal action against your parents for criminal intimidation and threats that they pose to your boyfriend and his parents.

1. Your boy friend and his family members shall have to lodge a police complaint against your parents alleging harassment and threat given for causing physical assault to them.

 

2. A copy of the said letter shall have to be sent to the local D.C. of Police.

 

3. If such threats accelerate, a petition u/s 156(3) of Cr.P.C. can be filed before the local Court praying for  a direction upon the local police to register FIR, investigate and act as per law based on the said complaint.

- Supreme court declared that , when  a man and a woman in love live together , is part of the right to life and not a criminal offence, and further live-in relationships is legal in India.

 - Hence, you both are major , then none having right to interfere in the relation of you and boy friend.

- If you think there may be trouble , then you can file a compliant before the police and higher official against the parents and thereby request for safety .

You cannot avail legal remedies on his behalf. He himself will to file a criminal complaint against them and can also ask for a protection order from High Court.

Your Boyfriend and his family can also file for a restraining order against your parents in civil Court violation of which would amount to contempt of court.
