• Birthdate correction

I got my passport on based adhar card and it was wrong birthdate when on based same i got passport but when i get my school leving certificate i realized my adhar and passport has wrong birth date than i correct birth date in adhar than i have applied for correction in passport but i dont have birth certificate and no records found in municipalities now RPO is asking about to Furnish birth certificate and explanation for dob correction DOB is before 1989

Get an affidavit executed before the 1st Class Judicial Magistrate affirming your actual date of birth mentioning that the date of birth mentioned in all your documents are incorrect which are required to me corrected by the authorities and your date of birth shall be considered as the D.O.B. mentioned in the instant affidavit.

 

2. Based on this affidavit, you can get the D.O.B. of all your documents corrected. and issued afresh.

If the passport authorities are  instructing you to furnish birth certificate, you may have to first approach the Municipality with an application to issue the same.

If the municipal authorities express that there are no records available in their register about the particulars/details of your birth then you get a non availability certificate and then apply for a direction in a private case before the jurisdictional judicial magistrate court , to direct the Municipal authorities to register your birth in their register as per the details you have furnished relying upon substantial documentary evidences in your possession, produced before court.

After this process is completed you may approach the municipal authorities with the court order and obtain the birth certificate accordingly.

After that you can apply for re-issue of passport with correct date of birth as per the birth certificate by enclosing a copy of the birth certificate.

An affidavit should be filed before the RPO. It should be specifically mentioned that why did you state the previous dob and on what document is the present dob based upon.

Following is the procedure under Births and Death Registration Act for obtaining birth certificate …

  1. Apply to municipal authority as per the date of your actual birth. Municipal authority will give a certificate that no such birth is registered on that date.
  2. Submit an application to the Executive Magistrate/Tahsildar for direction to municipal authority for birth certificate  on the said date with following  .
  3. A notarized affidavit stating that you birth took place at home on the said date and the same is not registered.
  4. No birth registered certificate issued by municipal 
  5. Notarized affidavit of mother and father stating that you birth took place on that date and it is not registered.
  6. Executive Magistrate/Tahsildar will give direction to municipal authority for issuing birth certificate.
  7. Take that direction to municipal authority and apply for birth certificate  on said date.
  8. You will get required birth certificate on payment of Rs. 50/- fee to municipal 
  9. All the above process can be done from abroad through GPA issued of relative attested by Indian Consulate

- If you not having a birth certificate , then you can apply for getting the same after furnishing the address proof of your parents and yours before the birth registrar 

- This address proof should be from the place of your birth and from the period of your birth date .

- However, as you having your school leaving certificate , then after submitting the same you can also corrected in passport after moving an application for the same.
