• Rent agreement notice period and rent payable

Hi All,

As a tenant, I have my registered rent agreement in Mumbai from 8th Feb 2020 to 7th Dec 2021. It mentions that after 6 month lock-in period, I can give one month notice in writing to landlord and vacate. I gave my notice middle of 15th June 2021. Am I expected to pay full month rent from 8th July 2021 to 7th Aug 2021? Or only from when I gave my one month notice on 15th June 2021 i.e. 15th June to 15th July 2021?

You have to give rentals for only one month notice period ie till 15 th July 2021

You gave notice on 15th June. But the month had already started. Now you have to vacate on or before 15th July. That means you have to pay the rent of July too till 7th August.

That is usually done. In emergency or in case of some new development people have to immediately give notice and therefore have to pay extra.

But usually notices should be given just before the rent is due.

After lock in period you can give one month notice. Means till 08 September you have to pay rent.

If your notice period begins on the date of the notice and you have expressed that you would vacate at the end of the notice period, then you may have to pay the rent till the date you are staying in the rented premises.

The notice period is construed to begin from the date of the notice and it would be incorrect to calculate the notice period on the basis of the calendar month.

The rental mount may be paid as per the calendar month but the same principle may not be applicable to the notice period for vacating the rented premises.

You are liable to pay the monthly rental till the date on which you deliver the vacant possession to the landlord.

Dear Madam/Sir,

1. No, it is not mandatory that you give a notice on the exact date when the rents are paid. You may give it anytime prior to that.

2. Unfortunately, you will be expected to pay the full month rent from 8th july to 7th august, unless the rent agreement provides otherwise. A careful perusal of the rent agreement, will help you determine what legal action you may take.

- Since the rent agreement having provision of one month notice for vacating the premises before expiring the period , then both parties are bond to comply the same legally. 

- Hence, if you have already given the notice to the landlord as per rent agreement provisions , then the landlord cannot claim rent from August onwards. 

- Your notice is after completing the six months lock in period , hence you have right to vacate without paying further rent.
